Welcome to Smart Mate Technology. By using our website, purchasing our products, or engaging our services, you agree to the following Terms and Conditions. Please read them carefully.
1. Overview of Services
Smart Mate Technology provides licensed electrical and low-voltage services, including home automation, networking, AV systems, security, lighting, and related solutions. We offer product sales, professional installation, configuration, and system programming.
All work is performed by qualified technicians in accordance with applicable local, state, and national codes.
2. Estimates and Quotes
- All estimates are valid only for the timeframe stated in the estimate, not to exceed 10 calendar days.
- Estimates are subject to change based on site inspections, availability of materials, and unforeseen conditions.
- Estimates are not binding until formally accepted and signed by both parties.
3. Payments and Billing
- Payment terms, including deposit and installment schedule, will be clearly outlined in the estimate.
- A deposit is required at the time of booking. Remaining payments must follow the agreed-upon schedule.
- Accepted payment methods include check, ACH transfer, or approved online platforms.
- Late payments may be subject to interest or administrative fees.
- We reserve the right to suspend services or withhold deliverables until payment obligations are met.
4. Change Orders
If a change to the original scope of work is requested during the course of the project, additional charges may apply. Any such changes may also affect the project timeline.
5. Cancellations and Rescheduling
- Cancellations must be requested at least 24 hours before scheduled service.
- Cancellations within 24 hours may result in forfeiture of part or all of the deposit to cover administrative or scheduling losses.
- Any custom-ordered or non-returnable products are non-refundable once the order has been placed.
6. Product Sales and Warranty
- Products sold by Smart Mate Technology are covered by the manufacturer’s warranty only, unless otherwise specified in writing.
- We are not responsible for performance issues or failures due to misuse, third-party alterations, or environmental factors.
- Warranty service does not cover labor unless explicitly stated.
7. Installation and Site Conditions
- The Client is responsible for ensuring the site is ready for service, including access to electrical panels, clean work areas, and the absence of construction delays or obstructions.
- Any delay caused by site inaccessibility or interference may result in additional charges.
- All installations are performed to code; any work outside our licensed scope may be referred to a third party.
8. Programming and Configuration
- Custom programming and configuration services are tailored to the client’s system and environment.
- All software code, configurations, and system files developed by Smart Mate Technology remain the intellectual property of the Company unless otherwise agreed in writing.
- Unauthorized duplication, modification, or redistribution is strictly prohibited.
9. Confidentiality of Estimates and Pricing
All pricing, scope details, and documentation included in estimates or invoices provided by Smart Mate Technology are considered confidential and proprietary. Clients may not share this information with third parties, including competitors or other contractors, without prior written consent from the Company.
10. Permits and Compliance
- Unless otherwise stated, it is the Client’s responsibility to obtain all required permits and approvals.
- We can assist with the permitting process upon request for an additional fee.
11. Liability and Indemnification
- Smart Mate Technology is not liable for incidental, indirect, or consequential damages resulting from service delays, system failures, or equipment issues.
- Clients agree to indemnify and hold harmless Smart Mate Technology, its technicians, and affiliates against claims, damages, or legal costs arising from misuse, unauthorized changes, or third-party interference.
- Our total liability is limited to the amount paid by the Client for the affected service or product.
12. Force Majeure
We are not responsible for delays or failure to perform due to events beyond our control, including but not limited to natural disasters, labor strikes, material shortages, acts of God, or governmental restrictions.
13. Dispute Resolution
- These Terms shall be governed by the laws of the State of California.
- Any disputes will first be addressed through mediation. If unresolved, the matter may proceed to binding arbitration or court in the appropriate jurisdiction.
- The prevailing party in any legal action may recover reasonable attorney’s fees and costs.
14. Changes to Terms
We reserve the right to update or modify these Terms and Conditions at any time without prior notice. The latest version will always be available on this page. Continued use of our services constitutes acceptance of any changes.
